USITC Probes Samsung, Apple And Google Over Spatial Audio Patents

A USITC patent investigation could restrict imports and sales of Samsung, Apple, and Google devices over alleged spatial-audio IP infringement. No infringement has been established yet.

The US International Trade Commission (USITC) has formally instituted Section 337 investigation No. 337-TA-1521 into certain electronic devices incorporating audio technologies from Samsung, Apple, and Google.

The investigation, announced on 16 September 2026, follows a patent complaint filed by audio technology company BoomCloud 360 Inc. on 14 August, with a supplemental filing submitted on 31 August. The company alleges that imported and sold devices from Apple Inc., Samsung Electronics, Samsung Electronics America, and Google LLC infringe its patents.

The dispute centres on spatial and enhanced audio processing technologies, including techniques designed to improve the separation and balance of sound between left and right speakers for a more immersive 3D-audio experience. Potentially affected Samsung products include Galaxy smartphones, tablets, and other devices with relevant audio features.

BoomCloud 360 has requested a Limited Exclusion Order and cease-and-desist orders. If ultimately granted, affected products could face restrictions on their importation into and sale in the US.

However, the investigation does not establish patent infringement. An Administrative Law Judge will examine the allegations and issue an initial determination, which can be reviewed by the USITC.

The dispute is also being contested in federal court. Samsung filed a declaratory judgment case against BoomCloud 360 on 3 September, while Apple and Google filed similar actions in August.

The USITC will establish a target completion date within 45 days of instituting the investigation.
